Expert Witness Success for Angus Ramsay

Angus Ramsay, Director at RMA, acts as a Technical Expert and Expert Witness both for HKA and independently for clients through RMA.

Earlier this year Angus successfully completed the training and passed the exams for an advanced professional award in Expert Witness Evidence.

Over the last few years Angus has worked for HKA as an Independent Technical Expert and provided a number of Expert Reports to HKA clients.

One of these projects required Angus to act as an Expert Witness. The case was an multi-track International Chamber of Commerce (ICC) arbitration case involving a multi-million Euro dispute over the failure of an industrial machine.

Angus was cross-examined in the first part of the hearing in January 2020. Since then a further hearing took place and the judgement has recently become available. An email was received confirming the judgement of the Tribunal from the legal firm Angus was working for:

We wanted to let you know that we finally have received the decision from the Tribunal on the ... case. I’m sure you will be pleased to know that ... claim on the ... was dismissed in full. The Tribunal examined your evidence in detail and accepted your conclusions over those from ... and .... This obviously is a great result for ... and very satisfying for us!

We of course want to thank you for all your hard work on the case. Your analysis was absolutely crucial to achieving such a good outcome. An extract of the award, with the part covering the ..., is attached for your perusal.

This project has been a great success for Angus and demonstrates his ability to both provide compelling Expert Reports but also to offer sound evidence under cross-examination.

In addition to working for HKA, Angus has been approached as an independent Technical Expert in other legal cases. In particular Angus has recently offered his services as a Technical Expert in a case involving the strength of a large reinforced concrete slab where the reinforcement had not been laid according to the design drawings.

The cases described above involve large sums of money and, associated, large fees. There are many other cases which require the same sort of rigor but cannot afford the sort of costs normally involved in such cases. Such cases might still be of interest to RMA and potential clients should still approach us to see whether we can assist.
